Acceptable Use Policy
Internet Acceptable Use Policy (IAUP)
I. General IAUP Policy
a) The Karcher Group, Inc. (TKG) is a provider of Internet / World Wide Web access, web hosting, server collocation, and other Internet related services; and
b) TKG offers these services to allow customers to access information for commercial, non-commercial, private, and public purposes; and
c) TKG has developed the following IAUP to clearly define acceptable network use, and require adherence to guidelines established by the Internet community which are summarized in this IAUP. Additionally, it also clearly defines actions to be taken when use falls outside of these constraints, and furthermore defines the customers rights and obligations; and
d) TKG reserves the right to take preventative or corrective actions when violations of this IAUP are observed.
II. Revisions and Policy Availability
a) This IAUP will be revised from time to time; and
b) The updated IAUP will be posted on TKG’s website at http://www.tkg.com/acceptable-use-policy; and
c) Use of TKG services after posting will constitute acceptance of any new or additional terms.
III. Liability of Information
a) The Internet constitutes a global source that has no central managing body to monitor the validity of information ; and
b) By the nature of this open exchange, we rely quite heavily on the judgment and responsibility of those who use the internet; and
c) TKG cannot verify, warrant, or vouch for the quality or accuracy of information that users acquire and also that some posted material may be offensive in nature.; and
d) Because this assurance cannot be made, TKG cannot accept any responsibility for injury to its users, customers, or subscribers that occur as a result of the nature of the information obtained; and
e) However, when users post information that is carried over TKG’s network, or in any way uses TKG services to affect TKG’s goodwill, business reputation, and operations; or similar affect to any of its business partners, TKG reserves the right to take action as prescribed in this IAUP.
IV. Purpose
a) The purpose of this IAUP is to enhance the quality of the services and to protect TKG's customers, and the Internet community as a whole, from illegal, irresponsible, or disruptive Internet activities; and
b) This AUP applies to each customer and its employees, agents, contractors or other users of such customer who obtain services from TKG; and
c) Each user should use common sense and good judgment in connection with the services.
V. Prohibited Uses
a) Customers and users may not use TKG services for any of the below and such any such violation will constitute reasonable to take action according to Violations and Remedies prescribed below.
b) Send bulk unsolicited mail over the Internet (spam or spamming); or
i. Use TKG as a relay for such mail; or
ii. There are no open SMTP relays within the TKG network; and
iii. Upon receiving a written complaint, TKG has the right to investigate and make sole judgment as to whether mail was for legitimate business purpose, including but not limited to ensuring an “opt-in” option.
c) Utilize the services for any type of illegal activity, including but not limited to fraud, hacking, copyright violations, patent violations, illegal gambling, torturous activity, illegal drugs, pornography or nudity of any kind, forging of message headers, denial of service attacks; and
d) Utilize TKG services in any manner that violates applicable law; and
e) Utilize services in connection with any other disruptive or abusive activity, including:
i. Use services to cause denial of service attacks against TKG or other network hosts; or
ii. Post messages or programs that consume excessive CPU time, or as otherwise defined through individual
Service Level Agreements (SLA) with specific customers; or
iii. Sell or provide access to scripts, or other attempts to subvert TKG security; or
iv. Use services to impersonate or assume the identity of another person; or
v. Use services to post or distribute any virus, work, Trojan, or malicious computer code; or
vi. Use services to perform port scans or other invasive procedure against any server; or
vii. Use services to advertise or promote unsolicited commercial email or Spam; or
viii. Use services in any manner, at TKGs sole discretion, that is harmful to the public image, reputation,
goodwill of themselves or business partner, including but not limited to sexual, hateful, vulgar, racially, ethnically,
or otherwise objectionable materials.
ix. Use services to otherwise circumvent technical access restrictions, including but not limited to firewall restrictions,
port listening, local shell access, Peer to Peer sharing, tracking services, and web browser vulnerabilities.
x. Use services in any other manner to interrupt or interfere with the Internet usage of other persons.
VI. Violations and Remedies
a) TKG encourages users to report violations of this policy by e-mail to abuse@tkg.com, including any information that may be useful in ascertaining the source of said violation
b) TKG does participate in various SPAM monitoring programs including abuse.net and AOL spam monitoring services.
c) In the event that TKG learns of an event that it deems to be in violation, and after investigation to determine the source of the violation, TKG reserves the right to take the following action during any consecutive 365 day period:
i. First offense: written notice by e-mail; request and confirmation to cease violating activity or to otherwise investigate
suspicious activity
ii. Second offense: written notice by e-mail, placement on 30 day probation
iii. Third offense: written notice by e-mail, suspension of services for 30 days
iv. Fourth offense: written notice by email, cancellation of services
